The Spanish legal system is a little different from other European legal systems and it is possible to make the necessary checks and enquiries in a similar way to those made in the UK. There are many websites and programmes telling you about the pitfalls of buying property in Spain, but provided you have all the appropriate legal advice, purchasing a property in Spain is as safe as it is at home.
When purchasing a property in Spain there are several different types of contracts available and we are happy to discuss which one best suits your needs. It is customary in Spain for buyers to sign a preliminary agreement with a small payment that ensures the property is taken off the market. This is a signed contract which is legally binding to all parties.
When buying a new property the main things to be checked that we offer as part of our service are that:
- The vendors are the registered owners of the property.
- The legal description of the property and its boundaries is accurate.
- There are no debts, charges or mortgages attached to the property as you will then become liable for them.
- There is an outline planning permission and a building license.
- All bank guarantees or insurance policies will be issued to secure the payments made until completion of your property purchase.
The Canary Island Tax regime is slightly different than the one in mainland Spain and very different from that in the UK. The Canary Island government offer an incentive for buying property on Fuerteventura. For properties under construction the IGIC, which is what the Canary Island Tax is called, will be paid at 5% of the purchase price rather than the VAT at 7%. In addition to this you will also have to pay AJD or Document Tax at 0.5 % of the purchase price, rather than 1% as it is in mainland Spain.
